These Terms of Service ("Terms") govern your access to and use of the websites, software, reports, calculators, APIs, applications, and services (collectively, the "Services") provided by Milestones Retirement Insights Inc. ("Milestones", "we", "our", or "us").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.

 

1. About Milestones Retirement Insights

 

Milestones Retirement Insights provides retirement income planning software, calculators, projections, reports, educational content, and related services designed to assist individuals, financial advisors, and organizations in evaluating retirement income strategies.

The Services are intended to support planning and decision-making but do not replace professional financial, legal, tax, accounting, or investment advice.

2. Eligibility

 

You may use the Services only if you have the legal capacity to enter into a binding agreement under applicable law.

If you are using the Services on behalf of a company, employer, or organization, you represent that you have authority to bind that entity to these Terms.

 

3. Accounts

 

Certain Services require registration and creation of an account.

 

You agree to:

• Provide accurate and complete information.

• Maintain the confidentiality of your login credentials.

• Promptly update account information when necessary.

• Notify us immediately of any unauthorized access or security concern.

 

You are responsible for all activity occurring under your account.

 

4. Subscription Plans and Fees

 

Certain Services are provided on a paid subscription basis.

Subscription pricing, billing frequency, and included features are displayed at the time of purchase.

By subscribing, you authorize Milestones to charge applicable fees using your selected payment method.

Subscription fees are billed in advance and are non-transferable.

 

5. Free Trials

 

Advisor subscriptions may include a free trial period.

 

Unless cancelled before the trial period ends, the subscription will automatically convert to a paid subscription and the applicable fees will be charged.

 

Trial eligibility is determined solely by Milestones.

6. Refund Policy

​

Milestones offers a 30-day refund period from the date of initial subscription purchase.

Refund requests must be submitted within 30 calendar days of the original purchase date.

Refund eligibility may not apply to:

• Renewals;

• Enterprise agreements;

• Custom implementation services;

• Consulting or professional services already delivered.

 

Milestones reserves the right to investigate suspected abuse of the refund policy.

 

7. Retirement Planning and Financial Information Disclaimer

 

The Services provide projections, calculations, reports, educational content, and planning tools based on information supplied by users and assumptions selected within the platform.

 

The Services:

• Do not provide investment advice.

• Do not provide legal advice.

• Do not provide tax advice.

• Do not guarantee financial outcomes.

• Do not create a client-advisor relationship with Milestones.

 

Users remain solely responsible for evaluating recommendations, assumptions, and financial decisions.

Financial planning consultations, where offered, are provided separately by appropriately licensed professionals and are subject to applicable regulatory requirements.

 

Past performance, projections, forecasts, and illustrations are not guarantees of future results.

 

8. User Responsibilities

 

You agree not to:

• Use the Services for unlawful purposes.

• Attempt to gain unauthorized access to systems or accounts.

• Reverse engineer, decompile, or copy the Services except as permitted by law.

• Interfere with the security or operation of the Services.

• Upload malicious software or harmful code.

• Use automated systems to scrape or harvest data without authorization.

 

9. Intellectual Property

 

The Services, including software, reports, designs, graphics, content, calculations, trademarks, and underlying technology, are owned by or licensed to Milestones and are protected by intellectual property laws.

 

Except for limited rights granted under these Terms, no ownership rights are transferred to users.

Users may use reports generated through the Services for their own personal or business purposes consistent with their subscription.

 

10. Customer Data

 

You retain ownership of information and data you submit to the Services.

You grant Milestones a limited right to process, store, transmit, and display such information solely for the purpose of providing the Services.

 

Milestones will handle personal information in accordance with its Privacy Policy.

 

11. Availability of Services

 

Milestones strives to maintain reliable service availability but does not guarantee uninterrupted access.

 

We may:

• Modify features;

• Improve functionality;

• Perform maintenance;

• Suspend access for security reasons;

• Discontinue portions of the Services.

 

Reasonable efforts will be made to minimize disruption.

 

12. Security

 

Milestones maintains administrative, technical, and physical safeguards designed to protect customer information.

 

However, no system can be guaranteed to be completely secure. Users acknowledge and accept the inherent risks associated with internet-based services.

 

13. Third-Party Services

 

The Services may integrate with or rely upon third-party providers, including cloud hosting providers, authentication providers, payment processors, and other technology partners.

Milestones is not responsible for the products, services, availability, or actions of third-party providers.

14. Suspension and Termination

 

Milestones may suspend or terminate access to the Services if:

• These Terms are violated;

• Required fees remain unpaid;

• Use of the Services creates security, legal, or operational risk.

 

Users may terminate subscriptions at any time through their account or by contacting Milestones.

 

Termination does not relieve obligations incurred before termination.

 

15. Disclaimer of Warranties

 

The Services are provided on an "as is" and "as available" basis.

 

To the fullest extent permitted by law, Milestones disclaims all warranties, express or implied, including warranties of:

• Merchantability;

• Fitness for a particular purpose;

• Non-infringement;

• Accuracy of results;

• Continuous availability.

 

Milestones does not warrant that calculations, projections, or reports will be error-free or suitable for every situation.

 

16. Limitation of Liability

 

To the fullest extent permitted by law, Milestones Retirement Insights Inc., its directors, officers, employees, contractors, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages.

 

Milestones' total aggregate liability arising from or relating to the Services shall not exceed the amount paid by the user to Milestones during the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not permit certain limitations of liability, and portions of this section may not apply where prohibited by law.

 

17. Indemnification

 

You agree to indemnify and hold harmless Milestones Retirement Insights Inc. from claims, damages, liabilities, costs, and expenses arising from:

• Your use of the Services;

• Your violation of these Terms;

• Your violation of applicable laws or third-party rights.

 

18. Enterprise Agreements

 

Customers operating under a separately executed Master Services Agreement, Subscription Agreement, or other written contract with Milestones shall be governed by that agreement to the extent of any conflict with these Terms.

 

19. Changes to These Terms

 

Milestones may update these Terms periodically.

Updated versions will be posted on our website with a revised effective date.

Continued use of the Services following publication of updated Terms constitutes acceptance of the revised Terms.

 

20. Governing Law

 

These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

The parties agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.
